ADVANCED Legal Aspects of Code Administration | ZOOM WEBINAR | November 19th, 2020

Please note that this seminar is part two of a two-day seminar with different topics, introduction and advanced, both related to legal aspects. This seminar is geared to ADVANCED legal aspects, the first seminar on October 21st is for advanced legal aspects.

ADVANCED COURSE DESCRIPTION: In addition to reviewing key concepts necessary for legal aspects of building code administration, Participants will be provided more in-depth material for effective code administration and enforcement of the legal aspects of the code for the code official. The following topics will be covered during the seminar: powers and duties of the building code official, permits, inspections, certificates of occupancy, unsafe structures, overcrowding, hoarding, rental inspections, administrative search warrants, using zoning ordinances to obtain compliance and effective techniques for enforcement, and using internet databases for corporate, LLC and real estate records.

Goal: Participants will be able to apply effective building code administration and enforcement techniques to assist them in executing the legal aspects of their job.

 Objectives: Upon completion of this seminar, participants will be better able to:

  • Identify the source and legal basis for their duties and powers.
  • Gather information that will enable the building official or inspector to identify the proper legal entity so that the correct person or company is given permits, stop work orders, certificates of occupancy, notices of violation and complaints.
  • Effectively enforce provisions of the model codes.
  • Avoid common mistakes made by building officials and reduce civil liability.
  • Apply the legal principles of the model codes to actual field situations.
  • Conduct constitutionally valid inspections.
  • Identify multiple ways to deal with unsafe structures
  • Understand the complexity of hoarding cases
  • Use zoning ordinances in enforcing building code problems
  • Be able to choose the right venue for enforcement

Instructor: Linda S. Pieczynski is a former assistant state’s attorney and former municipal prosecutor in DuPage County, Illinois.  She devotes her legal practice to teaching and writing about the legal aspects of code administration including building, property maintenance, fire and zoning codes. She conducts training nationwide for the International Code Council (ICC).  She is the author of numerous code related books including The Building Process Simplified, The Building Official’s and Inspector’s Guide to Codes, Forms and Complaints, The Residential Inspector’s Guide to Codes, Forms and Complaints, The Fire Inspector’s Guide to Codes, Forms and Complaints, and The Property Maintenance Inspector’s Guide to Codes, Forms and Complaints, all published by Cengage.  She also has served as editor of revisions to the Legal Aspects of Code Administration published by ICC.
